Mr. Lynskey is a partner at McCullough Watt Sutton Lynskey & Hodson. He is a skilled trial and appellate lawyer with his practice focused predominantly in the area of criminal defence. Mr. Lynskey also represents clients with respect to quasi-criminal matters including civil forfeiture proceedings, Mental Health Act reviews, and other select civil cases. He has successfully argued cases at all levels of court in British Columbia.
He has been counsel on a number of high-profile, serious and complex cases involving murder and white-collar crime. Notably, Mr. Lynskey was co-counsel on R v. Darling, securing a total stay of proceedings on a charge of first-degree murder following almost a year of litigation. This success, the best outcome for his client, also resulted in a review by the BC Prosecution service of Crown and police case management and disclosure policies in complex criminal cases.
Mr. Lynskey has a strong record of success in securing multiple acquittals in serious cases for clients on charges of sexual assault, drug trafficking, home invasion, unlawful confinement, firearms offences and fraud. Mr. Lynskey has also successfully secured a reduced charge of manslaughter in two other second-degree murder cases.
He has extensive experience advancing constitutional arguments, cross-examining expert witnesses including medical experts, and in bringing and arguing third-party records applications and applications challenging the admissibility of statements. Mr. Lynskey is a steadfast and savvy courtroom advocate. Known for being prepared, passionate and persistent, he brings a tenacity, work ethic, and competitiveness that reflects his background as a varsity athlete to each and every case he argues. While he has experience in complex criminal litigation at the highest level, many of his clients are professionals, students, and persons who have been charged for the first time, and have no experience with the criminal justice system. Mr. Lynskey was born and raised in Powell River, BC and attended high school in Vancouver. He received an Honors B.A. in English and History from the University of Toronto, where he was a wide receiver on the University of Toronto Varsity Blues Football Team. He received his JD from the University of Victoria Faculty of Law.
Outside of his busy practice, Mr. Lynskey volunteers his time as a guest lecturer on trial advocacy at the University of Victoria. He has also spent time guest lecturing to undergraduate and high school students on topics of introductory criminal law principles and procedures.
